Home and Community Based Services

Recipients of Medical Assistance may qualify under certain circumstances for additional assistance to pay for long-term care services that enable the recipient to stay in his or her home rather than a nursing home or hospital. A full discussion of these programs is well beyond the scope of this web page, and for additional information you may want to contact an attorney practicing in the elder law area and/or the Minnesota Department of Human Services (MDHS). MDHS has a very informative web site at www.dhs.state.mn.us. Briefly, home and community-based services offered through the Minnesota Department of Human Services can be broken into two general areas. In the first group are three programs for recipients under the age of 65 (including individuals with traumatic brain injury) who need a nursing home or hospital level of care. These are known as Community Alternatives for Disabled Individuals, or CADI, for individuals needing a nursing home level of care; Community Alternative Care, or CAC, for individuals needing a hospital level of care; and the Traumatic Brain Injury Waiver, or TBIW, for individuals requiring a nursing home level of care. The second group of programs is for individuals over the age of 65. These are the Elderly Waiver, or EW program, for those over 65 who require a nursing home level of care and qualify for Medical Assistance, and the state-funded Alternative Care, or AC, program for home health services for qualifying individuals over 65 years of age. To the extent these programs provide long-term care services, the recipient is subject to restrictions on transfers of assets.
